我國人口販運防制對策 – 法務部司法官學院
聯合國《打擊跨國有組織犯罪公約》附錄二《關於預防、禁止和懲治販運 人口特別是婦女和兒童行為的議定書》將人口販運定為犯罪，確保起訴並懲治 販運者，向受害人提供保護和援助並同時保護其人權，以此打擊和防止人口販 運。 台灣在美國國務院每年公布之人口販運報告（Trafficking in Persons Report）的排名，由第一級、第二級、第二級觀察名單的連年退後，顯示我國 在打擊人口販運所作之付出與努力，無法獲得認同，2007 年排名雖回復到第二級，但仍應持續加強各項防制人口販運作為，目標朝向第一級而努力。該報 告評價某一個國家等級之判斷標準，主要是從 3 個面向加以切入，第一是起訴 情形(prosecution)，第二是保護作為(protection)，第三是預防作為(prevention)， 即所謂之防制人口販運 3P 對策。本文除就最新之 2007 年人口販運報告有關 我國部分作一簡介與評析，也將我國「防制人口販運行動計畫」內容加以分析 …
誰的人權： 防制人口販運運動的人權家國階序
本文選擇從防 制人口販運（human trafficking prevention）運動這項由政府與民間婦女 宗教團體所主導的人權政策，透過其建構的脈絡與論述分析，指出人權 普世意義下，其實涵蓋了不同社會與政治位置之間的角力。同時，本文 特別針對防制人口販運運動中關鍵的「丟包事件」建構進行分析，說明 其角力不僅僅只是不同人權價值認知，更是反映了社會的性道德階序 （hierarchy）、國家主權的焦慮與不同社會階層的政治權力差異，而人 權保障反而是保障了主流性道德價值與再製臺灣政府在國際上「人權立 國」的想像，並且排斥了移民、移工、性工作者的人權。藉此，本文透 過突顯人權在具體政治與社會權力差異脈絡下的動態建構過程、以及建 構過程所反映的社會階序與政治權力關係，以點出權利（rights）即權 力（power），人權保障不僅僅只是訴諸普世但抽象的原則，更必須坐 落於實踐的脈絡，分析並拆解當中的權力結構。
