国际行动框架 执行《打击人口贩运议定书》
《行动框架》是一个技术性辅助工具，旨在协助联合国会员国有效执行联合国 《预防、禁止和惩治贩运人口特别是妇女和儿童行为议定书》（联合国《人口 贩运议定书》）。《行动框架》由一个叙述部分和一套表格组成。叙述部分介绍 在执行联合国《人口贩运议定书》方面面临的主要挑战，并提出可采取的一般 措施，以便更有效地应对这些挑战。一套表格进一步详细叙述这些措施，其中 分为五个支柱，均含有支持执行联合国《人口贩运议定书》的实际行动。
兩岸人口販運實務案例評析
為防制跨越海峽兩岸之人口販運犯罪，民國 98 年 1 月我國政府於法制面制定 《人口販運防制法》，增設被害人保護、犯行預防及人口販運罪處罰之規定，以落 實被害人人權保障及人口販運罪之偵緝。因《人口販運防制法》甫施行未久，實務 尚乏判例參考，本文乃援引適用《刑法》處罰之人口販運案件實務見解，及探討該 案適用《人口販運防制法》處罰之可能性。另針對被害人來源地之中國大陸，就來 源地、犯罪手法等面向之變遷，剖析中國大陸境內之人口販運現況，及中國大陸 《刑法》對於拐賣婦女兒童罪之刑事處罰、相關之刑事處罰規定之介紹，暨中國大 陸政府部門所表示意見之說明。又兩岸業於 98 年 4 月簽署《海峽兩岸共同打擊犯 罪及司法互助協議》，日後關於人口販運案件情資交換、協助偵辦、人員遣返、調 查取證、罪贓移交及罪犯接返項目，設有合作模式與運作機制可資遵循，至於是否 得有效遏止跨境犯罪，尚待實務運作。
