國際人權之保障已成為普世尊重之價值，犯罪被害人保護制度為國家人權保障 之重要指標，面臨人權保障國際化浪潮，現行犯罪被害人保護法互惠原則之相關 規定，與現代保障人權平等原則與精神不符，實有檢討修正之必要，政府基於人 權立國理念及實踐人道主義，將在臺外國籍與無國籍人士納入本法保護對象，以 確保渠等被害者在我國受到合理及平等之對待，使犯罪被害者人權保障更加周 延，也更確定政府重視被害人保護，未來的刑事司法政策，將會與先進國家以被 害人為中心(Victim-Centered)的刑事政策取向同步，尤其是被害人特別脆弱 (vulnerable)、更多為兒童與婦女的人口販運與性侵害這兩種類型的犯罪，更應入 列
